Captain Feline employs anthropomorphism to blend pop culture with cats. The results are a collection of fun t-shirts and limited edition art prints – purr-fect for displaying a combined love of cats and cult movie characters! この働き方と言う呼び方ですが、実際に「働き方」と言う名称の法律があるわけではありません。
実は、労働関係法令をまとめて呼ぶときの総称です。
そして、労働関係の法令には、みなさんが良くご存知の労働基準法を始め、職業人派遣法や、男女雇用機会均等法、それから、育児、介護休業法があります。
それから、職安法や労組法もはたらきのなかのひとつです。
働き方の中でも、みなさんがよく知っている、労働基準法は、休暇や賃金などについて定められているので、働く人にとっても一番、身近な法律だと言えるでしょう。
これらの法律の元となるものには、民法の雇用契約に関する定めもあります。
元は、日本国憲法の基本的人権の保障にまで、さかのぼって定められているものであり、労働関係の法律はとても奥が深いのです。
基本的なことではありますが、これらの法令は、「職業人を守るため」に存在しています。
そして、職業人を雇う側においても、法令を上手に活用することができれば、健全な職場を作ることも可能です。
職場が健全ですと、労働者も十分に力を発揮して働けるわけですから、結果的には会社の利益に繋がるというものです。
ですから、働き方は、働く人のための法律でありながら、雇用者側にも利用価値が高いものだと言えますね。
労働法には、休暇労働と賃金についても定められています。
みなさんも、よく「今日は休日出勤だ」とか、言いますよね。
例えば、通常は土日が休みになっている会社において、土日に働くことを「休暇出勤」と私たちは言っていると思います。
このような場合に使う言葉、休暇出勤と、働き方における休日労働とはちょっと意味が違ってきますし、支払われるお給料も違ってくるのです。
働き方の中の休息労働と言う言葉は、週1回、または、4週間に1回、定めてある法定休息に労働した場合がこれに該当します。
法定休息ではなく、法定外休息に労働した場合、これは休息労働とは認められません。
ちなみに、休暇労働をさせる場合、義務付けられていることがあります。
例えば、労働組合との三六協定の締結、また、労働基準局長への届出、それから、35パーセント以上の割り増し賃金を支払うこと、これらが義務となっています。
働き方にも定められている通り、休日労働をした場合、その賃金は35パーント増しで、支払う必要がありますが、仮に、この日、10時間、労働したとしても、賃金は実労働時間、「10時間の35パーセント増しのみ」でかまいません。
通常であれば、8時間を越えた分の2時間は、時間外労働となるわけですが、法定休日の場合、労働日ではないという前提のため、時間外という概念が適用されません。
法定外休暇の賃金は、週40時間以内で、1日8時間以内の場合は、通常賃金となります。
