これらの法律の元となるものには、民法の雇用契約に関する定めもあります。
元は、日本国憲法の基本的人権の保障にまで、さかのぼって定められているものであり、労働関係の法律はとても奥が深いのです。
基本的なことではありますが、これらの法令は、「働く人を守るため」に存在しています。
そして、職業人を雇う側においても、法令を上手に活用することができれば、健全な職場を作ることも可能です。
職場が健全ですと、職業人も十分に力を発揮して働けるわけですから、結果的には会社の利益に繋がるというものです。
ですから、働き方は、働く人のための法律でありながら、雇用者側にも利用価値が高いものだと言えますね。

労働法の中の休日労働と言う言葉は、週1回、または、4週間に1回、定めてある法定休息に労働した場合がこれに該当します。

労働法にも定められている通り、休息労働をした場合、その賃金は35パーント増しで、支払う必要がありますが、仮に、この日、10時間、労働したとしても、賃金は実労働時間、「10時間の35パーセント増しのみ」でかまいません。
通常であれば、8時間を越えた分の2時間は、時間外労働となるわけですが、法定休息の場合、労働日ではないという前提のため、時間外という概念が適用されません。
法定外休暇の賃金は、週40時間以内で、1日8時間以内の場合は、通常賃金となります。
